These Terms and Conditions (“Terms”) govern your access to and use of the GovBidder.AI website (“the Site”) and all related artificial intelligence–powered tools, software, and services (“the Services”).

GovBidder.AI is an exclusive platform available only to active members of GovBidder VIP 365, Tu Primer Contrato USA, or GovBidder BootCamp (“Eligible Programs”).

By accessing or using the Site or Services, you agree to comply with these Terms. If you do not meet eligibility requirements or do not agree with any part of these Terms, you must discontinue use of the Site and Services.

1. Acceptance of Terms

By accessing or using GovBidder.AI, you acknowledge and agree that:

You are an active, paying member of at least one of the Eligible Programs listed above.

You have read, understood, and agreed to be bound by these Terms, as well as any additional policies applicable to your membership or subscription.

Use of GovBidder.AI without meeting the eligibility criteria is strictly prohibited.

2. Use of the Site

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use GovBidder.AI strictly in accordance with these Terms and provided that you maintain an active membership in one of the Eligible Programs.

You agree not to:

Use the Site or Services in a way that damages, disables, or impairs the platform.

Attempt unauthorized access to the Site, systems, accounts, or networks.

Use bots, scrapers, or automated systems to extract platform data.

Share your access credentials with non-members or third parties.

Engage in unlawful, fraudulent, or harmful activities.

GovBidder.AI may monitor platform activity to ensure compliance and protect platform integrity.

3. Privacy

Your use of the Site is also governed by our Privacy Policy, which outlines how we collect, use, and protect your information.
By using GovBidder.AI, you consent to the practices described in the Privacy Policy.

4. User Accounts

To use GovBidder.AI, you must:

Be an active member of an Eligible Program.

Register using accurate and verifiable information.

Maintain the confidentiality of your username and password.

If your membership in any Eligible Program expires, is suspended, or is terminated, your GovBidder.AI access will also be suspended or terminated.

You are solely responsible for all activities conducted under your account.

5. Disclaimer of Warranties

GovBidder.AI and all related tools and services are provided “as is” and “as available,” with no warranties of any kind.

We do not guarantee that:

The platform will be free from interruptions, errors, or defects.

AI-generated recommendations or documents will be accurate, complete, or suitable for any particular purpose.

Issues will be corrected immediately or at all.

We disclaim all implied warranties, including merchantability and fitness for a particular purpose.

6. Limitation of Liability

To the fullest extent permitted by law, GovBidder.AI and its owners, affiliates, and employees shall not be liable for:

Direct, indirect, incidental, or consequential damages.

Loss of revenue, profits, data, or business opportunities.

Errors or inaccuracies in AI-generated documents, analytics, or recommendations.

This limitation applies even if GovBidder.AI has been advised of the possibility of such damages.

7. Intellectual Property

All platform content—including software, algorithms, branding, designs, text, graphics, videos, and training materials—is owned by GovBidder.AI or its licensors.

You may not:

Copy, distribute, or reproduce platform materials.

Reverse-engineer any part of the platform.

Create derivative works.

Use GovBidder trademarks without written consent.

Unauthorized use may result in termination and legal action.

8. Ownership of Content Created Using GovBidder.AI

All documents, analyses, proposals, and materials created, uploaded, or generated through GovBidder.AI (“User Content”) remain the exclusive property of the user.

GovBidder.AI does not claim ownership.

You grant GovBidder.AI a limited license to:

Store User Content.

Process it exclusively to operate platform features.
Maintain platform security and performance.

Provide support.

User Content will never be used or shared for other purposes unless required by law or authorized by you.

Users are solely responsible for the legal and technical accuracy of all User Content.

9. Links to Third-Party Websites

GovBidder.AI may contain links to third-party websites.
We do not endorse or control these sites and are not responsible for:

Their privacy practices

Their security

Use of third-party sites is entirely at your own risk.

10. Modifications to Terms

We may modify these Terms at any time. Changes become effective immediately upon posting.

Your continued use of GovBidder.AI constitutes acceptance of updated Terms.

11. Subscription Services

GovBidder.AI requires an active paid subscription in addition to program eligibility.

By subscribing, you agree to:

Provide accurate billing information.

Authorize recurring charges based on your selected plan.

Pay all associated subscription fees.

11.1 Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle unless canceled before renewal.

There is no free trial period for GovBidder.AI.

11.2 Refund Policy

Except where required by law or specifically stated in a promotional offer:

All payments are final.

No refunds or credits will be issued for unused time, partial billing cycles, or subscription renewals.

GovBidder.AI reserves the right to modify pricing or features, with changes taking effect in the next billing cycle.

12. Termination

We may suspend or terminate your account immediately if:

You violate these Terms.

You lose eligibility (e.g., your membership in GovBidder VIP 365, GovBidder BootCamp, or Tu Primer Contrato USA lapses).

You engage in conduct that harms the platform or its community.

You may cancel your subscription at any time; however, no refunds are provided for remaining time in the billing cycle.

13. Governing Law

These Terms shall be governed by the laws of the State of New Jersey.
Any disputes must be resolved in state or federal courts located in New Jersey.

14. Indemnification

You agree to indemnify and hold harmless GovBidder.AI, its affiliates, and its personnel from any claims, damages, or losses arising from:

Your use of the Site or Services

Your User Content

Your violation of these Terms
